1. Introduction
Welcome to Cheat and Mate ("Company," "we," "us," "our"). By purchasing, accessing, or using our software, browser extensions, or any related services (collectively, the "Services"), you ("User," "you," "your") agree to be bound by these Terms of Service ("ToS"). If you do not agree to these terms, you are expressly prohibited from using the Services.
2. Description of Services
Cheat and Mate provides a subscription-based software tool designed to interface with third-party chess platforms. The Service is intended solely for educational and entertainment purposes to analyze game theory.
3. User Acknowledgments and Assumption of Risk
You expressly acknowledge and agree that the use of the Services is strictly at your own risk. You fully assume all risks associated with the use of the Services, including but not limited to the termination, suspension, or banning of your accounts on third-party platforms such as Chess.com, Lichess.org, or any other online chess server. You understand that the third-party platforms actively monitor gameplay and have sophisticated anti-cheat detection systems.
4. No Liability for Third-Party Actions
Cheat and Mate is not responsible, and shall not be held liable, for any actions taken by third-party companies against your user accounts. This includes, without limitation, account closures or permanent bans, public shaming or revocations of titles by chess federations or platforms, loss of digital assets, ELO ratings, virtual currency, or tournament winnings, and any damage to your reputation or psychological distress resulting from being caught cheating.
5. No Guarantee of Undetectability
While we strive to update our software to remain functional, we make no guarantees, warranties, or representations that the Services are undetectable by anti-cheat software. Technology and detection algorithms evolve constantly.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Cheat and Mate, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use the Service.
7. Subscription, Refunds, and Chargebacks
Access to the Cheat and Mate software requires a paid subscription. Due to the digital and instant-access nature of our product, all sales are final. We do not offer refunds once the software has been delivered or activated. If your account on Chess.com or Lichess is banned after purchase, you are not entitled to a refund. Initiating a payment dispute or chargeback with your financial institution will result in the immediate and permanent termination of your Cheat and Mate license, and your personal information may be blacklisted from future services.
8. Indemnification
You agree to defend, indemnify, and hold harmless Cheat and Mate from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of and access to the Service, or your violation of any term of these ToS.
9. Service Updates and Downtime
Cheat and Mate reserves the right to temporarily or permanently shut down the Services for maintenance, updates, or legal pressure without prior notice. We are not liable if the cheat is patched by a chess platform and requires time to update.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to its conflict of law provisions. Any disputes arising from these ToS must be handled confidentially through binding arbitration, and you waive your right to participate in a class-action lawsuit.
11. Acceptance
By ticking the box at checkout or accessing our software, you confirm that you have read and agree to these Terms of Service in their entirety.
